Our updated home is 15 minutes to the casinos and Heavenly Ski Resort at Stateline and only 10 minutes to Lake Tahoe and Sierra at Tahoe Ski Resort. Restaurants, bars, parks, trails, the Truckee River, a Crossfit Gym and a grocery store within walking distance. Wifi and many other amenities included for guest use.
RENTAL AGREEMENT SUMMARY
Arrival and Check-In: Check-in time is 4:00 PM. Once Airbnb confirms full payment and this signed rental agreement is returned we will send detailed check-in instructions.
Departure and Check-Out: Departure and check-out time is 11:00 AM. Requests for late check-out must be approved at least 48 hours prior to check-out. Our cleaners are prepared to clean the residence at the time of check-out.
Cleaning Fee: A cleaning fee has been set based on complexity of a normal cleaning. Any unusual or excessive cleaning will be considered an excess damage cost. Guest will be contacted to process any additional cleaning fees.
Maximum Occupancy: The maximum number of occupants in a VHR is strictly regulated by local ordinance. Exceeding the designated maximum occupancy of the rental unit will result in the immediate termination of the rental agreement and forfeiture of the entire rental amount and security deposit. Please make sure the number of beds is sufficient for your group.
Parties, Loud, or Unruly Behavior: Our home is located in a residential neighborhood and may not be used for weddings, receptions, or parties. Loud or unruly behavior is restricted by local ordinance and may result in citation or arrest by local law enforcement. Alcohol in the possession of minors is not permitted; as well as illegal possession of controlled substances by any guest. Breach of these provisions could result in the immediate termination of the rental agreement and the forfeiture of rental cost and security deposit.
Guest of record will be liable for any fines imposed by local Governmental agencies, where fines imposed will range from $250.00 to $1,000.00. Fines may be imposed for any violation of the local vacation rental ordinances including: noise violations, parking violations and maximum occupancy rules.
Furnishings and Supplies: Our home comes equipped with a fully stocked kitchen, linens/bedding, toiletries and bath towels. Some coffee, teas and spices are available for use. Two rolls of toilet paper and two rolls of paper towels will also be supplied. Guests may purchase additional supplies at the local supermarkets (Holiday Market is just up the street on HWY 50 and Raley’s and Safeway are located in town, about 10 minutes drive from the house). Two televisions are on the property; one in the master bedroom and one in the living room/common area. A front load washer and dryer is available for guest use, along with a jug of laundry detergent. Dishwashing detergent is also available and will be kept under the kitchen sink, alongside extra trash bags and spare paper towels. The wood burning fireplace takes a bit of finesse to get going, so we ask that it not be used at this time. If any renter is interested in learning how to use it, please contact us before attempting to begin.
Any modifications or alterations to any aspect or part of the residence or property will result in a $500 fine and an added fee based on the cost to repair said damage. At no time is any renter allowed to make modifications to the residence.
Pets: Pets are allowed at our residence upon full disclosure of type(s) and size(s). There is a large dog door located in the kitchen, next to the back sliding glass door and is available for use. The dog door must be closed any time renter’s are not at the unit and during the night to avoid any local wildlife access inside. Excessive cleaning that is required shall be charged the amount of $30 per hour over and above the prepaid cleaning fee and is considered an excess damage cost.
Smoking: Our residence is non-smoking. Evidence of smoking may result in the immediate termination of the rental agreement and loss of rents. ANY evidence of smoking after check-out shall result in a mandatory $250 charge to your credit card. NO EXCEPTIONS!
Parking: The maximum number of vehicles that are allowed is two (2), per the county. Two parking spaces are available in the paved portion of the driveway. Parking is a major issue during snow season and parking restrictions are strictly enforced to ensure snow removal services are not impaired. Cars must be parked off the street during removal operations or be subject to towing and/or citation at the vehicle owner’s expense.
Garbage: Garbage collection occurs once per week. Garbage will be picked up any time between 7 and 8 am on Monday mornings. Garbage must not be stored outside unless it is locked in one of our bear resistant receptacles or the ‘Bear Box’. Garbage can be placed out in approved bear proof cans no sooner than 6pm on Sunday and removed from the street no later than 6pm on Monday, if any remains, as per the county’s rules. Please remember that you are staying in the forest and human trash attracts animals. While bears, coyotes, and raccoons appear to be cute and friendly, they are actually wild animals and will behave as such. Additionally, many animals become dependent on human trash for food each year and eventually have to be killed.
THIS AGREEMENT, between the Guest of Record (Guest) and Owner's (Brittney and David Smith) is made in the City of South Lake Tahoe, County of El Dorado, State of California. The Guest must accept this agreement, as “agreed to” and such acceptance shall be on file with the owners prior to the release of entrance information to the Guest. This agreement is not transferable without the expressed written consent of the Owners.
CONDITIONS BEYOND OUR CONTROL: Guest acknowledges that the Owner has no control over many situations; no refunds will be issued for weather, snow or road conditions, power, cable television or telephone outages or other acts of nature, nor is any guarantee or warranty made as to the condition or quality of televisions, appliances, and the like. Every reasonable attempt will be made to put them in proper working order during your stay. Beyond this notification and these options offered, the Owner shall bear no further responsibility unless otherwise indicated.
HOLD HARMLESS DUE TO EVENTS THAT ARISE FROM NATURALLY OCCURING HAZARDS AND UNFORESEEN AND/OR UNPREDICTABLE OCCURRENCES. Guest is hereby alerted to the fact that certain hazards, and unforeseen and/or unpredictable occurrences are inherent within the geographical location of the Tahoe Basin, including but not limited to those that arise from weather, altitude and/or being the natural habitat of wild animals. It is the Guest's responsibility to familiarize themselves with such possible occurrences.
Treehouse and Trampoline Liability Waiver: A sturdy tree house and fenced/netted trampoline are on the property. These items are 100% USE AT YOUR OWN RISK. Owners advise that no renter use these while under the influence of any alcohol or substances. Anyone under the age of 18 years old MUST be accompanied by an adult 18 years or older to ensure their safety and proper use of equipment, if used. GUEST AGREES TO HOLD THE OWNERS HARMLESS IN THE EVENT OF ANY DAMAGE OR INJURY TO SELF OR PROPERTY, OR TO ANY ADDITIONAL PERSONS STAYING WITH THE GUEST DURING THEIR STAY OR ANY OTHER PERSON WHOMSOEVER IN CONNECTION WITH THE RENTAL OF THE RESIDENCE/PROPERTY. Any damage caused to said backyard equipment will result in the cost of fixing said damage by the Guest.
Further, Owners shall not be held responsible for any latent defects within or without the rental property that are beyond the scope of a diligent search for such defects. Guest agrees to hold the Owners harmless in the event of any damage or injury to self or property, or to any additional persons staying with the Guest during this rental or any other person whomsoever in connection with the rental of. IF, AT THE TIME OF ARRIVAL, YOU FIND PROBLEMS WITH THE RESIDENCE, IT IS YOUR RESPONSIBILITY TO CALL/CONTACT THE OWNERS AND REPORT THOSE PROBLEMS IMMEDIATELY. ABSOLUTELY NO REFUNDS OR COMPENSATION WILL BE CONSIDERED FOR COMPLAINTS MADE AFTER DEPARTURE.
The property that results from accident, injury, any effects of snow, ice, flood, defective construction, fire, theft, injury caused by contact with animals, and the like shall not be the responsibility of the Owner. Owners also shall not be liable for any error of judgment or for any mistake of fact or law, or for anything which it may do or refrain from doing hereunder, except in cases of willful misconduct, or gross negligence.
ARRIVAL & DEPARTURE TIME: Check-in time is 4:00 p.m.; check-out time is 11:00 a.m. No exceptions will be made unless authorized in advance and an appropriate notation has been made on the guest's confirmation letter and/or entered in the Airbnb reservation system. Guests arriving before 3:00PM or staying after 11:00AM are subject to an additional night's rent.
KEYS/ENTRANCE TO PROPERTY: The reservation must be fully paid for and this agreement accepted and that acceptance is on file with the Owners before key codes will be released to the Guest.
NUMBER OF GUESTS: The number of occupants allowed as overnight tenants is EIGHT and on the posted permit at the rental unit. This number includes both adults and children who sleep in their own beds (Infants under the age of 1yr not included).
MAXIMUM OCCUPANCY AS PER THE VACATION RENTAL ORDINANCE: Maximum occupancy for each rental unit is posted therein. Over occupancy will result in immediate eviction from the rental with no refund of rent.
DISTURBANCE OF THE PEACE; ILLEGAL ACTIVITIES: Disturbing the peace or disturbance of your neighbors or any illicit activity is a violation of local ordinance. If law enforcement officers are called, come to the unit and complete a substantiated "Disturbance Report” or similar complaint, eviction will be immediate and all of your rental funds will be forfeited.
FIREPLACE USAGE: IF the fireplace is used during your stay, do not remove ashes from the fireplace. Ashes will be removed by the housekeeper after your departure. Do not burn tree bark, pine needles, pinecones, cardboard etc. If desired to use, we must be contacted (via text, call or email) and will give specific instructions of use, as to avoid filling the house with smoke or damage to persons or property.
WINTER SEASON PARKING: If snow removal is in progress, street parking is not permitted by local ordinance. Cars in the way of snow removal equipment on any street are subject to being towed, impound fees, and parking fines.
WINTER SEASON SNOW CLEARING: Snow will be removed from driveways prior to arrival the first day of visit. Snow clearing will be performed if required during your stay if there is an accumulation of more than 4 inches of snow. Snow crews may request your cooperation in moving vehicles so they may clear the driveway. A snow shovel will also be available for use and located on the back porch, if needed.
ICE AND SNOW INJURY WAIVER: Owners will not be liable for injuries resulting from slips or falls on slippery surfaces or from falling snow or ice.
Ice and snow are a common occurrence in the winter season but can occur anytime throughout the year at Lake Tahoe. Guests must use extreme caution during times of ice and snow to avoid slipping or falling on slick surfaces and injuries resulting from snow and ice falling from roofs, trees, or other objects.
GUEST'S RESPONSIBILITIES AT CHECKOUT OF THE RENTAL PROPERTY: At checkout, Guests are expected to do the following -
KITCHEN: Dishes and cooking utensils are to be cleaned & put away. All food must be removed from the refrigerator (including the freezer).
TRASH: Trash is to be placed in cans and/or in the bear box provided outside of the home. Do not place any garbage in plastic bags outside the home!!!
BEDROOMS: Leave linens on bedding at housekeeper’s request.
BATHROOMS: Used towels shall be piled in one area all together, either in the hall bathroom or near the washing machine.
The thermostat must be set at 60 degrees when you leave the home. PLEASE! DO NOT TURN OFF THERMOSTAT/HEATER!!
Double check that you have packed all your personal items including cell phone chargers, toiletries from showers/bathrooms, food from the kitchen, snow gear from the back porch, etc.
ITEMS LEFT IN UNITS BY GUESTS: It is the responsibility of the Guest to notify the Owner of items left at the house. Check all closets and drawers and look under beds. Personal items found will be held for 20 days. A $25 service charge plus postage will be charged for mailing items back to guests.
AFTER HOURS ASSISTANCE: In the event of a police or fire emergency, call 911. For Public Utility emergencies check the posted notices by the front door for the correct emergency phone number. If there is a problem with your unit, please contact the owner's right away. If you require assistance due to your negligence (i.e., lost keys, maps, depleted hot water tank, etc.) you WILL BE CHARGED at the rate of $30.00 per hour (1 hour minimum). All Guests are responsible for getting everyone in their group to the unit.
LEGAL JURISDICTION: In the event of any legal action whatsoever, made the by either the Owners or the guest (and/or any member of their party), arising from this reservation, it is hereby agreed by these parties that the courts of proper jurisdiction in these matters shall be those located in the City of South Lake Tahoe for El Dorado County.
SEVERABILITY: Should any provision of this contract be found to be void, voidable, illegal or in any other way unenforceable, all other provisions herein shall remain in full force and effect.
ENTIRE CONTRACT: The foregoing is the entire contract between parties hereto. No other statements, promises, verbal agreements, assumptions and/or understandings are part
FURNITURE MOVING: Please do not move furniture. If the Owner has to replace original furnishing placement a charge of $50 will be charged to your credit card. Please be respectful of the property you are residing in as it is our family home.
INTERNET: Though we do advertise the fact that there is high speed internet at the property, that does not guarantee that said Internet Service will be available for all or part of your stay due to unforeseen circumstances. You are renting a property in the mountains and internet service can be spotty. We strive to maintain these connections but in the event internet service is not available at your chosen property no refunds or credits shall be given.
Our neighborhood is truly the best. It's safe and quiet, yet conveniently located just a few short blocks from HWY 50. It's central location gives you access to everything South Lake Tahoe has to offer within minutes. Our newly updated gourmet kitchen is complete with a gas stove, concrete countertops, a dual sink with a built-in drain board and a three person breakfast bar. We recently installed bamboo wood flooring throughout the living and dining area. There are two TV's, one located in the Master Bedroom and one in the living/common room. The kitchen, living room and dining area boast amazing views of our large, fenced backyard and Flagpole Peak. Dual band, high-speed wifi is available on site. Bed linens provided for each bed. Bath towels, hand towels and wash clothes provided. Front load washer and dryer available for guest use.
