Next children's playground
Leave the house and walk 30 meters to the right, then turn left into Schillersteig. You walk to the end and reach the Berliner Mauerweg. Turn left and after about 100 meters you will reach the playground.

+ If you turn right, you will reach Japan Eck after approx. 1 km. The Japanese state had donated the Japanese cherry blossom trees, which were planted along the Wall Trail after the fall of the Wall in 1989, to the city of Berlin. At the Japan Corner there are benches, you have a nice view and it is a nice place for a picnic. Until 1989 there was a military training area of the US Army in the immediate vicinity from the Berlin side.

§ 1 Booking / booking confirmation
If we can provide you with the desired holiday apartment in the desired period, you will receive a written confirmation from us. The reservation for the holiday apartment is legally binding upon receipt of the booking confirmation and after receipt of the deposit (see §2).

§ 2 Terms of payment
The guest pays the total amount (minus a deposit of 50% on arrival in cash at the landlord or transfers the amount before arrival to the account of the landlord. Deviating from these payment conditions the conditions of the mediation portals are valid with reservation.

§ 3 Arrival and departure
The holiday apartment will be available from 15.00 on the day of arrival. On the day of departure, the accommodation must be vacated by 11:00 am. Earlier check-in or later check-out is possible after arrangement with the landlord.
The apartment must be left swept clean on the day of departure. The dishes, glasses, etc. must be cleaned. The dishwasher must also be switched on. The rubbish bins must be emptied and the fridge emptied.

§ 4 Condition of the holiday apartment
The holiday apartment is handed over by the landlord in an orderly and clean condition with complete inventory. Should defects exist or occur during the rental period, the landlord must be informed immediately. The lessee is liable for any damage caused by him to the rented property, the inventory and the communal facilities, e.g. broken crockery, damage to the floor or furniture. This also includes the costs for lost keys (locking system). The inventory is to be treated carefully and only for the stay in the holiday flats. The tenant is also liable for the fault of his fellow travellers. Damages caused by force majeure are excluded. The contract can be terminated without notice if the holiday home is used contrary to the terms of the contract, such as subletting, overcrowding, disturbance of peace in the house, etc., or if the full rental price is not paid. The rent already paid remains with the landlord. If a liability insurance exists, the damage must be reported to the insurance company. The landlord is to be informed of the name and address, as well as the insurance number of the insurance.

§ 5 Stay
The holiday apartment may only be used by the persons listed in the booking. Should the apartment be used by more persons than agreed upon, a separate fee is to be paid for these persons, which is determined in the rental price. In this case the landlord also has the right to cancel the rental contract without notice. A subletting and transfer of the apartment to third parties is not permitted. The tenancy agreement may not be passed on to third parties. The tenant agrees to the "General Terms and Conditions of the holiday apartment as well as to the house rules - insofar as such are part of the rental property. The declaration of consent is made with the payment. In the event of violations of the GTC ́s or the house rules, the landlord is entitled to terminate the tenancy immediately and without notice. A legal claim for repayment of the rent or compensation does not exist.
The tenant is informed that the entrance area is video monitored. The landlord can demand a photo of the identity card or passport before arrival.

§ 6 Withdrawal from the trip
A necessary withdrawal from the trip must be notified in writing. The free cancellation of a holiday apartment is possible up to 30 days before arrival. In case of cancellation up to 14 days before arrival we charge a cancellation fee of 50% of the total price. After that we charge the full amount. Should you have booked via an internet portal, the travel cancellation conditions of the mediation portals apply. Instead of cancelling, you can also name another visitor.

§ 7 Cancellation by the lessor
In the event of cancellation on our part due to uninhabitability of the accommodation due to force majeure or other unforeseeable circumstances (e.g. average) which make it impossible to fulfil the contract, liability is limited to the refund of the rent.

§ 8 Liability of the lessor
The landlord is liable within the scope of the duty of care of a prudent businessman for the proper provision of the rental object. A liability for possible failures or disturbances in water or power supply, as well as events and consequences due to force majeure are hereby excluded.

§ 9 Written form
There are no agreements other than those specified in this contract. Verbal agreements have not been made. The general terms and conditions are accepted with transfer of the rental amount or payment of the rental amount in cash on arrival.

§ 10 User agreement on the use of Internet access
The owner operates Internet access via WLAN. He allows the guest to use the Internet access for the duration of his stay. The owner assumes no liability for the actual availability of Internet access. The guest is advised that the MAC address of his computer or smartphone is stored for the purpose of prosecuting criminal offences.

3. responsibility and indemnification of claims
The guest himself is responsible for the data transmitted via the Internet, the chargeable services used and legal transactions made. If the guest visits chargeable websites or enters into liabilities, the resulting costs are to be borne by him. He is obliged to comply with the applicable law when using the Internet. In particular:
- not to use the WLAN to retrieve or distribute immoral or illegal content; - not to illegally reproduce, distribute or make accessible any copyrighted goods;
- observe the applicable regulations for the protection of minors; - do not send or disseminate any harassing, defamatory or threatening content;
- not use the WLAN to send mass messages (spam) and / or other forms of inadmissible advertising. The guest exempts the lessor from all damages and claims of third parties, which are based on an illegal use of the Internet access by the guest and / or on a violation of the present agreement, this also extends to costs and expenses connected with the claim or their defense. If the guest recognizes or must recognize that such an infringement and / or such an infringement exists or threatens, he informs the landlord of this circumstance.

§ 11 Pets
Pets are not allowed in the holiday apartment.

§ 12 General information
The customer agrees to the processing of his data as far as this is within the scope of the purpose of the legal relationship. Smoking is not permitted in the entire house.

§ 13 Severability clause
Should one of the previously described rental conditions be legally invalid, it will be replaced by a provision that comes closest to the original provision. The other terms and conditions shall remain unaffected and valid.
